The United States Court of Appeals for the Ninth Circuit held the Board of Immigration Appeals (BIA) denial of Petitioner's motion to reissue the dismissal of her aslyum proceedings was an abuse of discretion and orderd the BIA to reissue the decision dismissing her appeal. Following remand, the parties negotiated a settlement with regard to EAJA fees.
