The Board of Immigration Appeals abused its discretion by failing to find that the alien was prejudiced by his prior counsel’s ineffectiveness, and by failing to provide a reasoned decision addressing his request to reopen sua sponte because he was eligible for adjustment of status based on the discharge of a prior New York state conviction.
